Trademark

A trademark is a sign that distinguishes the goods and services of one trader from those of others, in order to protect the company’s goodwill and profits.
Typically a trademark can be words (including personal names), indications, designs, letters, characters, numerals, figurative elements, colors, sounds, smells, the shape of the goods or their packaging or any combination of these.
A sign must be capable of being represented graphically in order for it to be registered as a trademark.
In order to increase the chance of successful, clients may try to provide a self-made design with meaningless wordings, unique and creativity.

The time required for application is about 6 months, valid period for the registration is 10 years, which could be renewed upon expiry.

Procedure of Trademark Registration in Hong Kong:

1. Client fill in the application form and sends to us.

2. We will contact the client in order to confirm all required information has been provided.

3. Client pays the deposit of HK$ 1,500 by cash or bank transfer to our bank account. (Hang Seng Bank #265-452193-001 or Bank of China #012-916-0-002670-3)

4. We will conduct the search to confirm if the proposed trademark is available for registration.

5. If it is available, we will commence the process of application upon receipt of the balance of payment. If it is not available, we will suggest the client to revise the trademark and conduct a search again (the search fee is borne by the client); if the client decides to discontinue the application, we will refund the fee after deducted handling charge of HK$ 500 and government fees paid.

6. We will submit the required documents and fees to the Intellectual Property Department for application.

7. A Certificate of Trademark Registration will be issued within 6 months. The valid period for the registration is 10 years, which could be renewed upon expiry.
